6. GOPHER HOLES, ANIMAL BURROWS, UNEVEN GROUND, AND NATURAL TERRAIN

WATCH YOUR STEP.

The Event takes place in a natural outdoor environment.

THE PROPERTY MAY CONTAIN GOPHER HOLES, ANIMAL BURROWS, DIVOTS, DEPRESSIONS, RUTS, ROCKS, ROOTS, SAND, LOOSE SOIL, MUD, HOLES, SLOPES, DROP-OFFS, UNEVEN SURFACES, AND OTHER NATURAL OR MAN-MADE GROUND CONDITIONS.

Some hazards may be:

  • Newly created after an area was previously inspected

  • Located on commonly traveled paths or gathering areas

Conditions may be particularly difficult to see at night or in crowded or low-light areas.

Walking, running, dancing, carrying equipment, consuming alcohol, or otherwise moving around an outdoor venue increases the possibility of encountering these conditions.

Potential injuries include sprains, fractures, torn ligaments, head injuries, falls, permanent disability, and death.

Holder is responsible for watching where they are walking and choosing whether an area is safe for them to enter or cross.

Holder expressly assumes these risks, including the risk of gopher holes and other concealed ground conditions, and releases claims arising from ordinary negligence relating to inspection, maintenance, lighting, warning, or condition of the premises to the maximum extent permitted by law.
